GENERAL TERMS AND CONDITIONS FOR RACES ORGANISED BY MARATHONGRUPPEN

1. GENERAL

These general terms and conditions (”General Terms and Conditions”) are valid for races organised jointly by athletics clubs, Hässelby SK and Spårvägens Friidrottsklubb. The terms ”Marathongruppen”, ”clubs”, ”we”, our”, ”ours” and ”us” refer to the athletics clubs, Hässelby SK (802411-9698) and Spårvägens Friidrottsklubb (802015-9979) jointly.

By registering (yourself or by another person) to one of the races which Marathongruppen organises (Race) you accept Marathongruppens General Terms and Conditions in force at that time.

In order to participate in certain races you must have reached a certain age, in which case the age limit is specified in the registration information. If you are younger than 18, a parent or guardian must approve the registration.

If you register another person in a Race, you are responsible for ensuring that this person has read, accepts and follows our General Terms and Conditions.

Note that certain races require a maximum time to finish the race. You must be aware of this and accept that we can close the Race before you have reached the finish line.

2. REGISTRATION, FEES AND PAYMENT

Information about Marathongruppen’s various races, possible choices and fees, various payment methods which apply to your registration to respective Races and the current General Terms and Conditions, can be found on the respective race’s website (”Website”) – which is available, via marathongruppen.se – and also in the confirmation of registration which you will be sent. Before you send off your registration please carefully read through and check that the information contained in your registration is correct.

When you register you must include the information which is specified as obligatory. By sending in your registration you certify that the information you have submitted is correct.

The range of payment methods can vary for Marathongruppen’s various races, but in general you are given a number of different payment possibilities, which can be found on the respective Website. In many cases, you have the possibility to pay with Swish, debit/credit card, direct transfer from a bank account, or by invoice. Payment from countries outside Sweden which are not serviced by Klarna, and for purchases using present cards or vouchers, payment can be made via Nets. To use the payment services, you may need to accept the general terms and conditions which apply for the payment method you have just chosen.

If you pay by debit card or bank transfer, you are responsible to ensuring that there is money in your bank account at the payment time. If the account does not have sufficient funds or if, for some other reason the money is unable to be withdrawn, your registration will not be processed.

If you have chosen an invoice as your payment method, the invoice must be paid by the specified due date. With late payments, Marathongruppen reserves the right to add interest, the right to charge a reminder fee and the right to compensation for costs incurred by debt collection according to law.

Payment by Klarna

If you choose to pay by Klarna, Klarna’s general terms and conditions apply in addition to what is stated above. Current terms and conditions for Klarna can be found here .

Note that in order for Klarna to be able to offer a range of payment methods, please note that they may need to share you personal, contact and order information with the provider of the particular payment service. The use of this information is regulated according to data protection legislation and Klarna’s privacy policy.

3. CONFIRMATION OF REGISTRATION

After you have registered, Marathongruppen will send you a confirmation of registration by email. You are responsible for checking that the information in the confirmation of registration is correct. If it is not, we ask you to contact us by email. For email addresses, see point 15, contact.

If you have not received your confirmation of registration within one week after payment, we ask you to contact us by email. For email addresses, see point 15, contact.

4. RIGHT OF CANCELLATION

Your purchase of a start place to the Race can be cancelled up to 24 hours after the purchase has been completed.

Note that the right of cancellation mentioned in the above paragraph, valid for the purchase of a start place to a sports event on a specific day or during a specific period of time is the only exception to the right of cancellation according to law (2005:59) about distance contracts and contracts outside of business premises. .

5. CANCELLATION

After the right to cancellation period, mentioned in point 4 has expired, your registration is binding and the registration fee is non-refundable. If you have chosen to pay by invoice, the invoice must be paid (whether you intend to participate in the Race or not).

In the case of sickness, injury or accident, there is a possibility of a refund of your registration fee from your insurance company. Contact your insurance company for further information.

6. CHANGE OF PARTICIPANT’S NAME

Registration to the race is personal and you can not let someone else run the Race in your name. For certain Marathongruppen Races, we offer the possibility to change the participant’s name in a start place. The change of participant’s name is permitted for:

- adidas Stockholm Marathon, for an administration fee of 300 kronor, and - adidas Premiärhalvan, Ramboll Stockholm Halvmarathon, Tjejmilen and Tjurruset, for an administration fee of 200 kronor.

If you want to change the participant’s name in a start place, you have to find your own replacement. The person who takes your start place will not automatically take the original place in a start group, but will be placed in a start group in accordance with Marathongruppen’s seeding rules. These can be found on the Website. The person who takes a start place must also accept these General Terms and Conditions before the change of participant’s name can be processed.

Note that you can not transfer your start place, according to the above guidelines, if you are part of a group registration. In this case, different conditions apply for transferring your start place to another person. If you wish to transfer your start place, you should instead contact your employer or other person responsible for the registration for further instructions.

Note that it is only possible to make a name change up until 10 days before the Race takes place. In order to process a name change or for further information on how it is done, we ask you to contact us by e-mail namnbyte@marathongruppen.se.

7. PERSONAL INFORMATION

When you buy a start place and register for one of Marathongruppen’s Races, we will process your personal data. Please read more about Marathongruppen’s personal data processing. here .

If, for personal reasons, you do not wish your name and year of birth to be shown in start or results lists, you can inform us by email: anmalan@marathongruppen.se. Remember to mention in the email which race(s) it concerns.

8. MARKETING

There will be photographers at our races. By agreeing to these General Terms and Conditions, you agree that names, images and films from the Race may be used on websites, in adverts and printed material for Marathongruppen itself or for one or more of our races, without a claim from you for compensation. If you do not wish your name or image to be shown, you can inform us by email (see point 15 Contact). State your name, start number and which race it concerns. We will consider pictures where you can be clearly identified, but not mass images where you are one of many participants.

9. RESPONSIBILITY

Participation in the race is at your own risk and we are, therefore, not responsible for any injury you incur by participating in the Race. Neither are we responsible for damage incurred to clothes or equipment which you use during the Race. We are not responsible for clothes or equipment left behind.

We cannot be held responsible to injury which is incurred by you in any way violating these General Terms and Conditions or the rules/instructions applicable during the Race.

10. CANCELLED OR ALTERED RACE

We reserve the right to cancel the Race, alter the course of the Race, change the start time/date it is held and/or other circumstances concerning the organisation of the Race:

a) due to circumstances beyond our control, including but not limited to national disaster, war, pandemic or other serious spread of disease, government action or lack of action, new or amended legislation, labour dispute, blockade, fire, flood, serious accident or comparable incident. b) If we or another authority deems it necessary for your and other participants’ health or safety, or c) If we are not granted the official permission which is necessary to be able to organise the Race.

Marathongruppen has no obligation to refund the registration fee to you or to pay damages or other compensation in the event that the conditions of the Race change (course, start time/date and/or other conditions concerning the Race’s implementation) or, in the worst case, the Race is cancelled, if this happens due to reasons mentioned in point a) – c) above.

11. SPECIAL INFORMATION CONCERNING COVID-19

Alterations in the organisation

Whether the race’s implementation will be wholly or partly affected by Covid-19 and the legislation, rules, restrictions and authority decisions taken in the light of Covid-19 (Corona rules) is still unclear. We, therefore, reserve the right to alter the Race’s course, start time/date and/or other conditions concerning the race’s implementation, if we deem it necessary to do so to comply with current Corona rules. Marathongruppen has no obligation to refund registration fees to you or to pay damages or other compensation in the event where the conditions for the implementation of the Race change for reasons outlined in this paragraph.

Reduced number of participants

We reserve the right to reduce the number of participants in the Race for reasons contributable to Covid-19, if we deem it necessary to do so in order to organise the race in accordance with current Corona rules. If the number of participants in the Race must be reduced, start places will be allocated in the order which registrations were confirmed by us, ie from the time of the confirmation of registration. If such a reduction in the number of participants results in you losing your start place, we reserve the race to only refund a part of your registration fee, in accordance with what is stated in the paragraph below. Marathongruppen has no obligation to refund a larger part of the registration fee or pay damages or other compensation in the event that the number of participants in the Race must be reduced in order for the Race to take place.

The amount of the refund you have a right to if you lose your start place because of the reduction in number of participants is based on (i) the date of the decision to withdraw your start place, and (ii) the current date the Race is due to take place at the time of that decision:

- >180 days before the date of the Race, 100% of the registration fee is refunded; - 90-180 days before the date of the Race, 75 % of the registration fee is refunded; and - <90 days before the date of the Race, 50 % of the registration fee is refunded.

Any refund of the registration fee according the above paragraph will take place 60 days after you have been informed that your start place will be withdrawn due to the reduction of the number of participants as a result of Covid-19

Cancelled Race

We reserve the right to cancel the Race for reasons attributable to Covid-19. If the Race must be cancelled for reasons attributable to the current Corona rules, your registration fee is refundable in accordance with what is stated below. Note that no refund is due if the Race is cancelled 0-3 days before the current date of the Race. Marathongruppen has no obligation, other than what is stated below, to refund the total or part of the registration fee, or to pay damages or other compensation in the event that the Race must be cancelled for reasons attributable to Covid-19.

The amount of the refund you have a right to if the Race is cancelled in order to comply with current Corona rules is based on (i) the date of the decision to cancel the race, and (ii) the current date the Race is due to take place at the time of that decision:

Any refund of the registration fee according the above paragraph will take place 60 days after you have been informed of our decision to cancel the Race.

12. COMPLAINTS

We make every effort to ensure that our customers are satisfied with our services. If you are dissatisfied, we, therefore, request that you contact us, so that we can do our best to resolve the situation. Contact us by email or visit us, contact details are found under point 15. If you are still dissatisfied, see point 14 below.

13. OTHER

We do everything we can to provide as accurate information as possible. However, we reserve the right to mistakes which may possibly arise in the information flow around the Race.

Marathongruppen has the right to unilaterally amend these General Terms and Conditions. Any amendments will come into force no earlier than 30 days after you have been informed of the amended General Terms by their publication on our Website. Should we make significant amendments to these General Terms and Conditions, you have the right to terminate the agreement you have made with us.

14. DISPUTES

If you are not satisfied with the Race, please contact us info@marathongruppen.se or 08-545 66 440. If you are still not satisfied, you can contact Allmänna reklamationsnämnden (National Board for Consumer Disputes), Box 174, 101 23 Stockholm, or the EU Commission’s online platform for the resolution of disputes: https://ec.europa.eu/odr We do not undertake to participate in alternative dispute resolution procedures, nor comply with the outcome of the dispute resolution procedures but we will take a final position concerning the issue in the event of a dispute / notified decision.
